The "Pledge Protection Act of 2005" (HR 2389) would strip all federal courts, including the Supreme Court, from the ability to hear challenges to the Pledge of Allegiance and from enforcing longstanding constitutional rights in federal court. This bill is the latest court-stripping bill that would deny access to the courts on specific topics, such as prayer in school and marriage of same-sex couples. Passage of this bill would erode the separation of powers and set a dangerous precedent on other issues. Further, it would eliminate access to the judicial system by victims of discrimination and others.
